    designated community participating in the Rural Community Immigration Class. Additionally, at least 75% of the work must be performed within that community, ensuring the program’s focus on addressing labor shortages in rural and northern regions of Canada.

  4. Qualified, Capable, and Likely to Accept:
    The applicant must demonstrate that they are qualified, capable, and likely to accept the job. This includes possessing the
    work experience or education that aligns with the lead statement and main duties described in the National Occupational Classification (NOC) for the occupation. The applicant must also show they are capable of performing the job and likely to accept and carry out the duties of the position.

  5. Recent Work Experience:
    The applicant must have relevant
    recent work experience that qualifies them for the job offer. This experience should be consistent with the criteria outlined in subsection 5(1) of the immigration regulations, unless exemptions apply (such as for international graduates or those with specific professional experience).

Minister’s Considerations for Assessing Genuineness

The Minister of Immigration will also evaluate the genuineness of the offer by considering the past compliance of the designated employer with both federal and provincial employment laws. This includes ensuring that the employer has followed all necessary legal procedures for hiring foreign nationals and recruiting applicants for the designated positions.
