Understanding Genuine Offers of Employment for the Francophone Community Immigration Class (FCIC)

  • Employment from a Designated Employer:

The job offer must come from an employer recognized and approved as a designated employer under the FCIC program.


  • Non-Seasonal, Full-Time, and Indeterminate Work:

The position must be full-time and non-seasonal, ensuring stability and economic integration.

Employment must be for an indeterminate period (no fixed end date).


  • Location in a Designated Community:

At least 75% of the work must be performed within the designated community where the job offer is located.


  • Qualifications and Suitability:

Applicants must demonstrate they are qualified and capable of performing the job.

Past work experience or education must align with the lead statement and main duties for the occupation, as described in the National Occupational Classification (NOC).


  • Relevant Recent Work Experience:

Applicants must meet the recent work experience requirements under subsection 5(1) unless exceptions apply under subsections 5(3) or 5(4) as explained below.


i.
Work Experience Requirement (Subsection 5(1))

Applicants must demonstrate work experience aligned with their job offer's TEER category in the National Occupational Classification (NOC):


  1. TEER 0 or 1: Experience in TEER 0, 1, 2, or 3.
  2. TEER 2: Experience in TEER 1, 2, 3, or 4.
  3. TEER 3 or 4: Experience in TEER 2, 3, or 4.
  4. TEER 5: Experience in the same NOC unit group as the offer.


Ii.
Exceptions to the Requirement subsections 5(3) or 5(4) 

Nursing Work Experience (Subsection 5(3)) Applicants with one year of work experience in NOC 31301 (nursing roles) within the past three years may qualify with a genuine job offer in:

  1. NOC 33102 (practical nurses) or
  2. NOC 44101 (home support workers).


Iii.
International Graduate Exemption (Subsection 5(4))

  1. Graduates with a recent eligible credential are exempt if:
  2. The credential was obtained within the past 18 months.
  3. The applicant was a full-time student throughout the program.
  4. For master’s/doctoral programs (<2 years): The applicant was physically present in the designated community during the program.
  5. For other programs (≥2 years): The applicant was physically present in the community for 16 of the 24 months before obtaining the credential.


By meeting these requirements or qualifying under exceptions, applicants can strengthen their case for permanent residence in Canada.

The Minister of Citizenship and Immigration evaluates the authenticity of the job offer by:

  • Assessing the designated employer’s compliance with federal and provincial laws regulating employment and recruitment.
  • Reviewing the track record of any recruiters involved in hiring foreign nationals for the designated employer.
  • Ensuring that the employer’s practices align with ethical and legal standards, providing a reliable foundation for the applicant’s immigration journey.
